These Terms and Conditions (“Terms”) govern your use of getprocontrol.com (the “Site”), operated by ProControl Smart Systems (“ProControl,” “we,” “us,” or “our”). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

About Us

ProControl Smart Systems is a licensed commercial security systems integration company based in Buffalo, New York, operating under New York State License #12000049052. We design, install, and service video surveillance, access control, alarm, and network infrastructure systems for commercial clients across Western New York.

Use of the Site

You may use the Site for lawful purposes only. You agree not to:

• Use the Site in any way that violates applicable law or regulation
• Submit false, misleading, or fraudulent information through any form
• Attempt to gain unauthorized access to the Site, its servers, or any connected systems
• Introduce viruses, malware, or other harmful code
• Use automated systems to scrape, harvest, or extract data from the Site
• Interfere with or disrupt the operation of the Site or its infrastructure

Quote Requests and Inquiries

Submitting a form on the Site is a request for information — it does not create a contract, reserve equipment, or obligate either party. All pricing, availability, and scope described on the Site or in preliminary communications is subject to change and subject to a formal site assessment.

Any binding agreement for design, installation, monitoring, or service will be set out in a separate written proposal or contract signed by both parties. In the event of a conflict between these Terms and a signed proposal or service agreement, the signed agreement controls with respect to that work.

SMS Communications

By providing your mobile phone number on the Site, you consent to receive SMS text messages from ProControl Smart Systems related to your inquiry, appointment scheduling, and service communications. Message frequency varies. Message and data rates may apply.

Reply STOP to any message to opt out of further text messages. Reply HELP for assistance, or call us at (716) 308-6910. Carriers are not liable for delayed or undelivered messages. Consent to receive text messages is not a condition of purchase.

Intellectual Property

All content on the Site — including text, graphics, logos, photographs, project imagery, proposal formats, and software — is the property of ProControl Smart Systems or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from Site content without our prior written permission.

Manufacturer names, product names, and logos referenced on the Site are the trademarks of their respective owners. Their appearance does not imply endorsement beyond our authorized dealer or integrator relationships.

Accuracy of Information

We work to keep the Site accurate and current, but we make no warranty that content on the Site is complete, accurate, or up to date. Product specifications, capabilities, and availability are provided by manufacturers and may change without notice. Do not rely on Site content as a substitute for a professional assessment of your specific property and security needs.

Disclaimer of Warranties

The Site is provided on an “as is” and “as available” basis without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.

Nothing in this section limits any warranty expressly provided in a signed installation or service agreement, or any warranty provided by an equipment manufacturer.

Limitation of Liability

To the fullest extent permitted by law, ProControl Smart Systems will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of, or inability to use, the Site. Our total liability arising from your use of the Site will not exceed one hundred dollars ($100).

This limitation applies to your use of the Site only. Liability related to installed systems, monitoring, or services is governed by the applicable signed agreement.

Security Systems Notice

No security, surveillance, or access control system can prevent all loss, injury, or property damage. Systems are a deterrent and a tool for detection and documentation. Nothing on the Site should be interpreted as a guarantee against burglary, vandalism, trespass, or other loss.

Third-Party Links

The Site may link to third-party websites. We do not control and are not responsible for the content, products, or practices of those sites. Links do not constitute an endorsement.

Indemnification

You agree to indemnify and hold harmless ProControl Smart Systems, its owners, employees, and contractors from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of your misuse of the Site or your violation of these Terms.

Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles. Any dispute arising under these Terms will be brought exclusively in the state or federal courts located in Erie County, New York, and you consent to the jurisdiction of those courts.

Changes to These Terms

We may revise these Terms at any time. Changes take effect when posted to this page with an updated “Last updated” date. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

Severability

If any provision of these Terms is found unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force.
